Divsion
The Icelandic Intellectual Property Office (ISIPO) can, at the applicant's request and upon payment of the prescribed fee, divide an application into two or more applications. The same applies to registrations. The new application/registration will retain the same filing date and priority date as the original registration, but will be assigned a separate registration number. The new application/registration cannot include the same goods and/or service class(es) as the original one.
The decision to divide an application/registration will be published in the Intellectual Property Gazette.
Documents required for the division of applications and registrations
A request for the division of an application/registration must include:
- The number of the application/registration to be divided.
- A list of the goods and/or services that each application/registration will include after the division.
The resulting application or registration cannot be broader in scope than the original application. Additionally, the new application/registration cannot cover the same goods or services as the original.
Once the request for division has been processed, the new application will be assigned a new independent number but will retain the same filing and priority dates as the original application, where applicable.
Once the request for division of a trademark registration has been processed, the new registration will be assigned a new independent number but will retain the same registration, filing, and priority dates as the original registration, where applicable.
Authorizations, transfer documents, and other records related to the original application/registration will also apply to the new application/registration created through the division.
